1. BUSINESS IDENTITY & NON-AFFILIATION DISCLAIMER

Luxe Scent & Skin Haven (luxscentskinhaven.com) is an independent luxury fragrance and skincare brand. We are not affiliated with, endorsed by, sponsored by, or connected to any designer house, luxury brand, or fragrance manufacturer including but not limited to Chanel, Dior, Parfums de Marly, Sisley, Tom Ford, Creed, Yves Saint Laurent, Givenchy, Hermès, Gucci, Burberry, or any other third-party brand. All designer brand names and trademarks referenced on this site belong solely to their respective owners and are used for comparative descriptive purposes only, in full compliance with the Federal Trade Commission (FTC) Act, 15 U.S.C. § 45, which permits comparative advertising provided it is truthful and non-deceptive.

2. OPEN PACKAGE & TAMPER POLICY — HEALTH & SAFETY NOTICE

For the health, safety, and protection of all customers, Luxe Scent & Skin Haven strictly enforces a NO RESALE OR RETURN policy on any opened, used, or tamper-evident-seal-broken products.

This policy is grounded in and supported by the following federal and regulatory standards:

  • OSHA Hazard Communication Standard (29 CFR 1910.1200) — Requires proper handling and labeling of chemical substances including fragrance compounds and cosmetic ingredients. Once a product seal is broken, contamination risk cannot be ruled out.
  • FDA Cosmetic Regulations (21 CFR Parts 700–740) — The FDA regulates cosmetics and personal care products for safety. Opened or used cosmetic and fragrance products may be subject to microbial contamination, oxidation, or adulteration, rendering them unsafe for resale or redistribution.
  • FTC Consumer Protection Guidelines — Resale of opened personal care products without disclosure constitutes deceptive trade practice.
  • CDC & Public Health Standards — Opened fragrance and skincare products applied to the skin or body are classified as personal use items. Once opened, these products may harbor bacteria, fungi, skin cells, or other biological contaminants that pose a direct health risk to subsequent users.

Therefore, by law and by policy:

  • All sales of opened products are final and non-returnable
  • Opened products cannot be resold, redistributed, or transferred to any third party
  • Any attempt to return an opened product for resale purposes will be refused and reported to the appropriate consumer protection authorities
  • Products returned with broken tamper-evident seals will be destroyed in accordance with health and safety regulations and will not be restocked

3. SUMMARY OF KEY POLICIES

  • Returns — Unopened items may be returned within 14 days. All opened items are final sale. A 15% restocking fee applies to eligible returns.
  • Damaged/Defective Items — Must be reported within 48 hours of delivery with photographic evidence.
  • 60-Day Molecular Transition Guarantee — Applies to fragrance performance concerns on unopened products only.
  • Shipping — Orders processed within 3–5 business days. Luxury delivery includes photographic documentation and GPS-tagged shipments.
  • Fraud & Chargebacks — Zero tolerance policy. Fraudulent chargebacks are reported to the FBI Internet Crime Complaint Center (IC3), USPS Postal Inspection Service, and applicable law enforcement agencies.
  • Privacy — Customer data is handled in accordance with our full Privacy Policy and applicable U.S. privacy law.
  • Intellectual Property — All brand content, imagery, copy, and product names are the exclusive property of Luxe Scent & Skin Haven. Unauthorized reproduction is subject to legal action.

4. LIMITATION OF LIABILITY

Luxe Scent & Skin Haven shall not be held liable for any adverse reactions resulting from misuse, improper application, or failure to review ingredient lists prior to use. Customers with known allergies or sensitivities are advised to review the Full Ingredient List (INCI) available on each product page before purchase.

5. GOVERNING LAW

This Legal Notice and all related policies are governed by the laws of the State of Alabama, United States of America, and applicable federal law.
